Freshlight Pty Ltd ("Freshlight", "we", "our") operates an escrow-protected online marketplace for buyers and sellers in South Africa. By registering or using the platform, you agree to these Terms of Service.
You must be 18 years or older and a South African resident to use Freshlight. We reserve the right to refuse service to anyone at our discretion.
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to keep it up to date. One account per person — duplicate accounts may be suspended.
When a buyer places an order, funds are held in escrow by Freshlight until the buyer confirms receipt of the item. Freshlight is not responsible for the quality or safety of items listed on the platform. A platform fee of up to 5% applies per successful transaction. Funds are released to sellers within 1 business day of buyer confirmation.
You may not list or sell: illegal goods or services, counterfeit items, stolen property, firearms or ammunition without proper licensing, controlled substances, adult content, or anything else prohibited by South African law. Listings violating this policy will be removed and the account may be suspended.
If a dispute arises, either party may raise a dispute within 48 hours of the escrow release deadline. Disputes are reviewed by trained mediators who will issue a binding ruling within 5 business days (24 hours for premium disputes). Both parties may appeal once within 48 hours of a ruling. Freshlight's decision on appeals is final.
To list items or receive payments, you must complete identity verification (KYC). We collect South African ID documents and verify them via Smile Identity. KYC data is handled in accordance with our Privacy Policy and applicable South African law including POPIA.
Listing is free. Freshlight charges a platform fee on completed transactions, calculated as a percentage of the transaction value plus VAT. Withdrawals incur a R10 processing fee. Fee schedules are displayed at checkout and may change with 30 days' notice.
Freshlight is a marketplace intermediary and is not a party to transactions between buyers and sellers. We are not liable for any direct, indirect, incidental, or consequential damages arising from use of the platform. Our total liability to you shall not exceed the platform fees you paid in the 12 months preceding the claim.
We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. You may close your account at any time, subject to any outstanding obligations.
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.
We may update these Terms from time to time. Material changes will be communicated via the platform or WhatsApp. Continued use of Freshlight after changes constitutes acceptance.
